Terms and conditions

1.

APPLICATION OF GENERAL TERMS AND CONDITIONS

1.1.

These general terms and conditions apply to all reservation requests, online orders, and agreements concluded, directly or indirectly, with Vitae Wellnessresorts.

1.2.

Vitae Wellnessresorts expressly rejects the application of other general terms and conditions.

1.3.

Exceptions to these general terms and conditions are only possible if agreed upon in writing by the parties.

 

 

2.

RESERVATION

2.1.

Vitae Wellnessresorts only processes reservation requests from persons aged 18 or older. Vitae Wellnessresorts reserves the right to refuse a reservation request without stating reasons.

2.2.

For online bookings/reservations, the agreement between Vitae Wellnessresorts and the customer is concluded at the moment the customer has definitively confirmed the reservation and/or payment has been made via the payment module. For telephone reservations, the agreement between Vitae Wellnessresorts and the customer is concluded when Vitae Wellnessresorts has sent the reservation confirmation to the customer by email.

2.3.

The customer must check the reservation confirmation for accuracy. Inaccuracies must be reported immediately to the relevant Vitae Wellnessresort.

2.4.

For an online reservation for a customer visit, the customer provides an expected arrival and departure time. Any treatments will be scheduled between the times indicated by the customer. Vitae Wellnessresorts never provides exact treatment times; the customer will be informed of these times upon arrival.

2.5.

If scheduling a possible treatment is not possible within the arrival and departure times specified by the customer, the relevant Vitae Wellnessresort will contact the customer by phone or email within two working days.

2.6.

The customer shall pay a (partial) payment to Vitae Wellnessresorts within the period specified in the reservation confirmation. Vitae Wellnessresorts is entitled to consider the agreement as not concluded if Vitae Wellnessresorts does not receive the agreed (partial) payment within the specified period. In that case, Vitae Wellnessresorts has the option to release the reserved services and/or entry access for other customers without further notice. In addition, Vitae Wellnessresorts has the right to charge cancellation fees.

 

 

3.

CHANGES TO THE RESERVATION

3.1.

Vitae Wellnessresorts is not obliged to make changes to the agreement at the customer's request after the agreement has been concluded.

 

 

4.

PRICES

4.1.

The customer owes Vitae Wellnessresorts the agreed amount, as stated on the reservation/purchase confirmation.

4.2.

The prices and additional costs are stated on the Vitae Wellnessresorts website, www.vitaewellnessresorts.nl, and all include VAT.

4.3.

Unforeseen price increases imposed by the government may be passed on to the customer. All prices on the website and other expressions such as brochures, posters, and flyers are subject to change and may be amended.

4.4.

Discount promotions published after a reservation/booking or purchase has been made cannot be applied retroactively.

 

 

5.

PAYMENT/CANCELLATION

5.1.

If the customer is unable to attend, we ask the customer to contact the relevant Vitae Wellnessresort by phone.

5.2.

No costs will be charged for cancelling a sauna visit only. If the customer has reserved a treatment or package including a treatment, Vitae Wellnessresorts applies the cancellation conditions stated under heading 5.3.

5.3.

If a booking/reservation is cancelled by the customer 24 hours or less before the arrival date, 50% of the reserved amount as per the reservation confirmation must be paid by the customer to Vitae Wellnessresorts within eight (8) days. If the customer does not arrive without cancelling and therefore does not make use of the treatment and sauna access, the customer must pay 100% of the reserved amount as per the reservation confirmation to Vitae Wellnessresorts within eight (8) days.

5.4.

The customer is not entitled to a (partial) refund of the amount if the customer, on their own initiative and due to their actions, was unable to use all services and/or accommodations.

5.5.

All e-tickets purchased via the webshop are subject to a cooling-off period of a maximum of 14 days, provided the e-tickets have not yet been redeemed.

 

 

6.

(HOUSE) RULES

6.1.

Customers must adhere to the rules established by Vitae Wellnessresorts. These can be found on the website and in the relevant Vitae Wellnessresort. Vitae Wellnessresorts has the right to immediately remove its customers from the relevant Vitae Wellnessresort if the house rules are violated and/or instructions from staff are not followed. In such a case, the customer is not entitled to a refund of (part of) the paid reservation, or already consumed food/drinks and/or treatments.

6.2.

Vitae Wellnessresorts has the right to ask the customer for valid identification before checking in. Vitae Wellnessresorts is entitled to refuse access to the relevant Vitae Wellnessresort to customers who cannot identify themselves.

6.3.

Vitae Wellnessresorts reserves the right to make changes to the layout and opening hours of the facilities of the relevant Vitae Wellnessresort. The customer will allow maintenance to take place at the relevant Vitae Wellnessresort during opening hours if necessary. The customer cannot claim compensation. The necessity of the maintenance is at the discretion of the management of Vitae Wellnessresorts.

 

 

7.

VALIDITY

7.1.

The validity of the tickets and/or gift vouchers in circulation is explicitly stated on the relevant ticket and/or gift voucher. If the validity of the relevant ticket and/or gift voucher has expired, the validity cannot be extended.

7.2.

A made reservation/booking is only valid on the day indicated by the customer. The customer cannot derive any rights from the reservation on other days.

7.3.

If the customer is in possession of a discount voucher, e-ticket, or another gift voucher, the customer must actually hand it in upon check-in unless explicitly stated otherwise. If the customer cannot present this discount voucher, e-ticket, or another gift voucher, Vitae Wellnessresorts is obliged to charge the full rate.

 

 

8.

LIABILITY

8.1.

Vitae Wellnessresorts accepts no liability for theft (including theft from lockers), loss, and/or damage to property or persons, of any kind whatsoever, during or as a result of a stay at the relevant Vitae Wellnessresort.

8.2.

Vitae Wellnessresorts accepts no liability for the fact that the customer's stay does not meet the expectations the customer had set for it.

8.3.

Vitae Wellnessresorts accepts no liability for damage or injury to property or persons arising from a stay on the grounds of the relevant Vitae Wellnessresort or arising from the use of the facilities present on the grounds.

8.4.

Vitae Wellnessresorts is not liable for claims for damages resulting from noise pollution caused by third parties.

8.5.

Vitae Wellnessresorts is not liable for damage resulting from oral or telephone information provided by its employees.

8.6.

Vitae Wellnessresorts is not liable for facilities and/or amenities becoming inoperable and/or unusable.

8.7.

The customer is obliged to pay all extra costs incurred due to incorrect use or incorrect leaving of the facilities.

 

 

9.

PRIVACY

9.1.

In compliance with the General Data Protection Regulation, Vitae Wellnessresorts will treat the customer's personal data strictly confidentially.

9.2.

We collect personal data regarding the customer's health solely for safety reasons and for the possible preparation of appropriate advice or an adapted treatment. This data is therefore used exclusively for that purpose and will not be provided to third parties without the explicit consent of the customer.

9.3.

The email address provided by the customer during the reservation or purchase process will be included in Vitae Wellnessresorts' email database, unless the customer has specifically opted out. Should the customer not wish to receive these emails, the customer can unsubscribe by clicking on the relevant link in every email received from Vitae Wellnessresorts. Telephone or email unsubscriptions will not be processed.

9.4.

By signing any authorization for direct debit, for example for a subscription, or by entering into a reservation/booking, the customer agrees to the processing of the customer's personal data as previously described in these general terms and conditions.

 

 

10.

COMPLAINTS

10.1.

Despite the care and effort of Vitae Wellnessresorts, the customer may have a complaint. Complaints can be reported directly to the reception of the relevant Vitae Wellnessresort. If a complaint cannot be resolved or is not resolved to satisfaction, the customer must send the complaint in writing or by email to the management. This procedure is absolutely necessary to properly handle the complaint.

10.2.

In all cases not covered by these General Terms and Conditions, the management of Vitae Wellnessresorts decides. By using the relevant Vitae Wellnessresort and all its facilities, the customer accepts these General Terms and Conditions.

10.3.

Dutch law applies to all agreements between the customer and Vitae Wellnessresorts.
